Erik Halverson is a first-chair PTO-registered patent litigator with a background in
engineering physics and materials science, and a member of the IP Litigation,
Post-Grant Patents, and IP Procurement and Portfolio Management practice groups. He
concentrates his practice in patent litigation and post-grant practice at the Patent
Trial and Appeal Board (PTAB). Erik has led trial teams for jury trials, conducted
opening statements and presented complex technical and financial witnesses to those
juries. In addition to his federal trial experience, Erik has experience arguing
before the PTAB, having served as primary counsel on over 100 IPR and PGR
matters. He is also well-versed in reexamination practice before the patent
office.
As a PTO-registered lawyer, Erik has experience with post-grant proceedings before
the PTAB. His involvement includes the preparation and prosecution of numerous inter
partes review and post grant review petitions, defense of challenged patents,
preparation of expert declarations, defending and taking expert depositions, and all
manner of motion practice before the PTAB. Additionally, Erik has experience arguing
in-person and remote inter partes review trials before the PTAB. Erik also has
extensive experience in the preparation of ex parte reexamination requests and
prosecution of claims that have been subject to reexamination. In all instances,
Erik's involvement in post-grant proceedings has been coupled with overall trial
strategy for co-pending district court litigations.
Erik is also experienced in all facets of patent litigation from initial motions
through post-verdict briefing and appeal. He has been involved in cases in the
Northern and Southern Districts of California, the District of Delaware, the Eastern
and Western Districts of Texas, the Southern District of Mississippi, and the
Eastern District of Virginia, among other jurisdictions across the country. His jury
trial experience includes conducting opening statements, the presentation of and
cross-examination of technical and damages witnesses in federal district court. Erik
also has experience presenting and cross-examining witnesses before the
International Trade Commission (ITC). At the Federal Circuit, Erik has secured
favorable outcomes for his clients by focusing on the issues that matter most and
approaching those issues from all angles.
Erik has experience handling standard patent prosecution matters as well as arguing
prosecution appeal matters before the PTAB. Erik also handles patent licensing, due
diligence, and counseling matters. His experience includes license negotiation and
drafting; joint development agreements and independent contractor agreements; and
international IP portfolio review.
