Eva Marie Weiler

Eva M. Weiler is a partner and a member of the firm’s Mass Tort and Product Liability practice groups. Eva defends corporations in science-driven class actions, coordinated proceedings, and individual matters. She has tried high-stakes cases in state and federal courts and in nationwide MDL litigation, cross-examining scientific experts and fact witnesses, making opening and closing arguments, and crafting trial strategy.

Eva regularly serves as the lead in-court lawyer in complex coordinated proceedings, managing large numbers of single and multi-plaintiff cases with multiple codefendants and handling complicated science presentations, bellwether-case selection arguments, large-scale document production format disputes, and jurisdictional challenges with the court. She has managed litigation teams, local counsel in multiple jurisdictions, and served as a law firm managing partner for years. Her communication skills and forthright demeanor have gained her credibility with judges, clients, and opposing counsel, which makes her effective at advocating for her clients in everything from delicate individual contract negotiations to high-volume litigation and aggressive discovery demands. 

Eva has broad experience working with clients across multiple industries, including pharmaceuticals and supplements; medical devices; construction, utilities, and security products; consumer goods and food and beverage; vehicles; and environmental sustainability. She counsels companies on state and national labeling and marketing claims, including, for example, with respect to the FTC Green Guides, biodegradability, recycling, and ingredient characterization. She advises on federal contracting status and pre-litigation communication and media strategy, and handles risk assessments and governmental investigations. In litigating these types of matters, Eva works alongside her clients at the micro and macro levels—developing strategy, conducting oral argument and defending witnesses, investigating and crafting company stories, and drafting dispositive briefing at the trial and appellate level. She enjoys finding creative solutions to problems that serve the ultimate business goals of each client.
